Hell of a Guy creates personalized products using photographs supplied by customers.

Each Hell of a Guy calendar is individually made to order.

Our personalized 2027 calendar may include:

• a personalized front-cover artwork;
• twelve personalized monthly transformations;
• printed calendar pages;
• associated digital artwork where included with the purchased product.

No two personalized orders are expected to be identical.

The personalized nature of the product means production is specifically undertaken for the individual order rather than from pre-manufactured finished stock.

You must be at least 18 years old to place an order.

By placing an order, you confirm that:

• the information you provide is accurate;
• you are legally capable of entering into the purchase;
• you have authority to use the photograph or photographs you upload;
• your use of those photographs does not knowingly infringe another person's rights.

If you upload an image of another person, including where the product is intended as a gift, you are responsible for ensuring you have lawful authority to provide that image for personalization.

You retain any rights you already hold in photographs you upload.

By uploading content to Hell of a Guy, you grant Hell of a Guy a limited licence to copy, process, modify and disclose that content only as reasonably necessary to:

• create your personalized artwork;
• perform image processing;
• conduct quality review;
• manufacture and print your product;
• deliver your order;
• provide digital files included with your order;
• investigate customer-support or quality issues;
• reproduce an affected order where appropriate.

This licence does not give Hell of a Guy permission to sell your uploaded photograph as a standalone image.

We will not intentionally publish your uploaded photograph in advertising, social media or promotional material without separate permission.

The quality of personalized artwork depends partly on the quality of the photograph supplied.

For best results, uploaded photographs should:

• clearly show the person's face;
• not be heavily blurred;
• not have the face substantially obscured;
• contain sufficient lighting;
• use a reasonably front-facing or clear facial angle.

Hell of a Guy may be unable to achieve the intended result where the source photograph is extremely low quality, highly compressed, obscured, cropped or otherwise unsuitable.

Hell of a Guy personalizes products using the photograph as it is supplied. We do not re-shoot or source the image on the customer's behalf.

For best results, the uploaded photograph should show a single, clearly front-facing person with the face fully visible and unobstructed.

The following issues may reduce the quality or recognizability of the finished artwork:

• non-front-facing, profile or turned-body photographs;
• eyewear, sunglasses, hats, masks or other face coverings that obscure the eyes, nose or mouth;
• group photographs or photographs containing more than one person;
• photographs where the face is small, cropped, heavily shadowed or otherwise difficult to detect.

Where a customer submits a photograph with any of these characteristics, Hell of a Guy will process and produce the order using that photograph as supplied. The finished product may reflect the limitations of the source image.

A preference for a different artistic result caused only by an unsuitable source photograph is not ordinarily a defect. We will assess each concern individually.

This does not affect any rights or remedies available to the customer under applicable law, including where a product fails to comply with a non-excludable consumer guarantee.

Hell of a Guy transformations are intentionally stylised, humorous and exaggerated.

Personalized artwork may alter:

• body proportions;
• clothing;
• pose;
• environment;
• hairstyle presentation;
• expression;
• lighting;
• profession or character styling.

The purpose of the product is to create a recognizable but entertaining transformation rather than a literal reproduction of the uploaded photograph.

We conduct quality checks designed to identify obvious generation, composition and printing problems.

However, personalization involves creative and automated image-processing processes and minor artistic variation is expected.

An exact photographic reproduction of the person's face, expression, pose or appearance cannot be guaranteed.

This does not affect any rights a customer may have where a product fails to comply with applicable consumer guarantees.

Orders are made specifically for each customer.

Once payment is accepted, personalized image creation and production preparation may begin quickly.

Because the order is individually created, changes or cancellations are not guaranteed after an order has been submitted.

Customers who discover an error immediately after purchasing should contact Hell of a Guy as soon as possible.

If production has not begun, we may attempt to accommodate a correction.

Once personalized production or printing has commenced, we may be unable to change or cancel the order.

You are responsible for checking:

• recipient name;
• email address;
• delivery address;
• postal code;
• apartment/unit number;
• photograph uploaded;
• product quantity;

before submitting the order.

Hell of a Guy is not responsible for additional costs caused solely by incorrect information provided by the customer.

Calendar-pack prices are shown in Canadian dollars (CAD). Shipping is free; applicable sales taxes and the full amount payable must be disclosed before a real order is placed.

Before purchase, customers must be able to review the product, quantity, total charges, delivery details, cancellation and return terms, and the merchant's contact information.

Payment is processed using third-party payment providers.

Hell of a Guy does not need to receive or permanently store your complete payment-card number in order to process your purchase.

An order is not confirmed until payment is successfully authorised.

Every personalized calendar is produced specifically in response to an individual order.

Hell of a Guy may use specialist technology, production, printing, logistics and fulfilment providers to assist in creating and delivering orders.

The identity of individual operational suppliers may change from time to time.

Hell of a Guy remains the customer's point of contact for the purchase.

Calendars are made in Canada and include free shipping. Delivery is expected within 3–7 business days from the order date. We do not currently accept orders for delivery to Quebec. This timeframe does not remove any statutory right to cancel if delivery is late.

Delivery may occasionally be affected by circumstances outside our reasonable control, including:

• carrier delays;
• weather;
• transport interruptions;
• peak-season demand;
• incorrect addresses;
• unsuccessful delivery attempts.

Customers are responsible for ensuring somebody can receive or collect the parcel where required.

Where a digital artwork pack is included, the customer receives a personal, non-exclusive licence to:

• download the files;
• retain them personally;
• share them with family and friends;
• post them on personal social-media accounts.

Unless expressly authorised by Hell of a Guy, digital artwork may not be:

• resold;
• commercially licensed;
• reproduced as competing merchandise;
• used to create counterfeit Hell of a Guy products;
• used in a way that suggests endorsement by Hell of a Guy.

Customers should download and save digital artwork promptly.

Personalization files may not remain stored indefinitely.

Hell of a Guy retains all rights in:

• the HELL OF A GUY name;
• logos;
• calendar templates;
• graphic design;
• branding;
• website content;
• slogans;
• product concepts;
• layout elements;
• proprietary artwork elements.

Purchasing a product does not transfer ownership of Hell of a Guy intellectual property.

Do not upload material that:

• you have no lawful right to use;
• infringes copyright, privacy or other rights;
• contains unlawful material;
• is submitted for fraudulent purposes;
• is intended to impersonate someone unlawfully;
• is intended to harass, threaten or exploit another person.

Hell of a Guy may refuse or cancel an order where content creates a legal, safety or operational concern.

If Hell of a Guy cancels an order for reasons unrelated to customer misconduct after payment has been taken, an appropriate refund will be issued.

Personal information and uploaded photographs are handled in accordance with the Hell of a Guy Privacy Policy.

The Privacy Policy forms part of these Terms.

We do not ordinarily accept change-of-mind returns for personalized goods, subject to any mandatory cancellation or return rights that apply where you live.

However, nothing in these Terms removes any rights available to you under applicable consumer protection law.

If goods are defective, misdescribed or not delivered as required by law, applicable provincial or territorial consumer-protection and sale-of-goods laws may provide cancellation, repair, replacement, refund or other remedies. Our policy cannot limit those rights.

To the maximum extent permitted by law, Hell of a Guy is not liable for loss arising solely from:

• incorrect customer-supplied information;
• unauthorised use of a photograph supplied by a customer;
• customer misuse of a product;
• failure to collect a parcel;
• an incorrect delivery address provided by the customer;
• delays outside our reasonable control.

Nothing in this clause excludes liability that cannot legally be excluded, including rights and remedies available under applicable consumer protection law.

You are responsible for claims arising from your knowing submission of photographs or material that you had no lawful authority to use.

This clause does not make you responsible for loss caused by Hell of a Guy's own unlawful conduct, negligence or failure to comply with a non-excludable legal obligation.

Hell of a Guy will not be responsible for delay caused by events outside our reasonable control where permitted by law.

We will take reasonable steps to resume performance as soon as practicable.

Hell of a Guy may update these Terms from time to time.

The Terms applying to a purchase will generally be the version presented at the time the order was placed.

These Terms are governed by the laws that apply to your purchase in Canada. Any mandatory rights under the laws of your province or territory remain unaffected.

Nothing in this clause prevents a customer from relying on any mandatory rights available to them under applicable law.
